Experience

Mr. Farrell’s practice focuses on civil disputes in the areas of real estate, construction, and employment. He is a seasoned litigator and trial attorney focused on representing professional individuals as well as regional, national and international entities in both California state courts and U.S. District Courts.

Real Estate and Construction: Mr. Farrell’s real estate practice includes representing managers, owners, developers, property buyers and sellers, landlords, tenants, and homeowners. His litigated matters including lien and mortgage foreclosures, unlawful detainers or evictions, breach of lease, quiet title, commercial and industrial landlord/tenant disputes, breach of purchase and sale agreements, partnership/LLC disputes, and claims alleging fraud, non-disclosure and breach of fiduciary duty by brokers, agents, and sellers.

Mr. Farrell offers particular insight into litigating business disputes involving construction projects, such as claims for breach of contract, mechanics liens, and related construction remedies. He works with construction industry clients to resolve construction claims and disputes in mediation, arbitration and litigation. Mr. Farrell has successfully represented large and small business entities, business owners and operators, construction companies and independent contractors and sub-contractors, design professionals, material suppliers and real estate investors.

Mr. Farrell is valued for his deep bench of experience in all facets of state and federal court litigation, including pleadings analysis, discovery, alternative dispute resolution, trial preparation, and trial. He has tried matters in multiple California Superior Courts, as well as advocated client positions in dispute resolution via voluntary mediation, arbitration, and court mandated settlement conferences.

Employment Litigation: In the employment arena, Mr. Farrell has represented employers in both individual and class action lawsuits and arbitrations. His employment expertise involves the defense of action alleging employment discrimination, harassment, wrongful termination, and retaliation; minimum wage, overtime, meal and rest period violations, and other wage and hour claims; unfair competition and trade secrets. Mr. Farrell has also assisted on appeals involving novel employment issues involving the California Family Rights Act (CFRA) and The Family and Medical Leave Act (FMLA). He has also counseled and advised employers on aggrieved employee claims for penalties brought under California’s Private Attorney General Act (PAGA). In addition to his litigation prowess, Mr. Farrell is also appreciated for his ability to resolve even the most hotly contested employment disputes outside of court in arbitrations or mediations.
