Stuart Kane Settles ADA Lawsuit for Shopping Center
Many property owners, including shopping center owners, have been sued under the Americans with Disabilities Act (ADA) based on allegations of improperly restricted access, misplaced grab bars, noncompliant signage, and a multitude of other issues. A client of Stuart Kane LLP was recently sued by one of these “serial plaintiffs” for alleged ADA violations. The portion of the shopping center at issue, however, was scheduled for demolition and construction of an entirely new, ADA-compliant, building and parking area.
After the ADA lawsuit was filed, lead counsel Don Hamman, with support from paralegal Tiffany Jung, negotiated a nominal settlement for less than $5,000, and dismissal of the lawsuit against the shopping center owner and three retail tenants.
